As annoying as spam is, I agrea with the Virginia Supreme Court’s decision to strike down the current anti-spam law. The way it was written was a challenge to free speech due to some poorly worded sentences. Here’s what I suggest as a replacement:
It shall be a class 1 [max 12 months, $2500 fine] misdemeanor to send out bulk, pornographic, or fraudulent unsolicited electronic mail messages for commercial purposes. In addition it shall be a class 4 [2-10 years, $100,000 fine] felony to either send more than 10,000 of the before mentioned electronic messages, or have the sender falsely and intentionally identify and impersonate itself with an already existing person or company.
